Health

K&M Pets LLC is a USDA licensed facility and our animal husbandry is overseen by a Doctor of Veterinary Medicine. By purchasing an animal from K&M Pets LLC you are agreeing that K&M Pets LLC makes no representation or warranties about the health or condition of the animal. You are accepting the animal as is at the time of purchase and that the value of the animal remains the same regardless of health or condition. No refunds or exchanges will be given by K&M Pets LLC because of current or future health problems. 

K&M Pets LLC provides information regarding care, diet and housing for animals on their website but this information is not a substitute for professional veterinary care. K&M Pets LLC is not liable for any inaccuracies listed in the information provided on the care pages found on their website or any damages incurred by following that information.

Temperament

By purchasing an animal from K&M Pets LLC you are agreeing that K&M Pets LLC makes no representation or warranties about the temperament or personality of the animal. You are accepting the animal as is at the time of purchase and agree that the value of the animal remains the same regardless of temperament or personality. No refunds or exchanges will be given by K&M Pets LLC because of undesirable temperament or personality of an animal. 

Shipping

By requesting airline shipping, the buyer agrees to any risk to the animal’s health or wellbeing involved in Delta Cargo shipping. Details of Delta’s policies and requirements for shipping can be found on their website.

Due to the cost, time and risk involved in shipping a live animal, all sales are final and a refund will not be issued for any reason other than the rare instance that an animal is deceased upon arrival.

Age

Births of animals born at our facility are recorded as accurately as possible but due to the nature of isolation necessary for some animals to breed, birthdates recorded may not be exact but are as close to accurate as possible. Ages of animals not born at our facility are estimates made according to limitations of our knowledge. By purchasing an animal from K&M Pets LLC you are accepting an animal as it appears at the time of purchase and agree that the value of the animal remains the same regardless of age. No refunds or exchanges will be given by K&M Pets LLC because the estimated age of an animal is deemed inaccurate by yourself, a veterinarian or any other party. 

Gender

Genders of animals sold by K&M Pets LLC are confirmed with visual inspection only. If the gender of an animal is unable to be determined by visual inspection, we will indicate that the gender is unknown. By purchasing an animal from K&M Pets LLC, you are agreeing that sometimes mistakes can be made when identifying the gender of an animal but that the value of the animal remains the same regardless of gender. No refunds or exchanges will be given by K&M Pets LLC because the gender identified at the time of the sale is found to be inaccurate by yourself, a veterinarian or any other party.

Buyer Responsibilities

By purchasing an animal from K&M Pets LLC you agree that it is your (the buyer’s) responsibility to acquire proper housing and care for the animal and establish professional veterinary care for the animal. Buyer assumes all responsibility for any costs involved in providing veterinary care, keeping and properly caring for the animal. 

It is the responsibility of the buyer to be informed of and understand any laws in their municipality, state or country of residence regarding an animal before they purchase the animal. K&M Pets LLC is not liable for any claims, legal actions, losses, injury, costs, expenses or liabilities whatsoever in connection with your purchase and/or ownership of this animal. By purchasing an animal from K&M Pets LLC the buyer agrees to adhere to any local, state, federal or international laws regarding the ownership of the animal. No refunds or exchanges will be given by K&M Pets LLC because the buyer cannot legally own the purchased animal or if the animal is repossessed because of legal action, now or in the future.

Entire agreement/modification/binding effect

This purchase agreement is the entire agreement between K&M Pets LLC and you (the buyer) and supersedes any prior understandings between you and K&M Pets LLC with respect to the subject matter of this agreement. No modification of this purchase agreement will be valid unless in writing duly signed by both parties. This purchase agreement is binding upon your and our heirs, assigns, successors, personal representatives, and executors. This agreement is between the parties contained herein.
