These Terms and Conditions ("Agreement") govern all purchases made from Custom Creatures Pet Shop ("Company," "we," "us," or "our"), whether in-store, online, or through any remote transaction. 

By purchasing any animal, product, or service from Custom Creatures Pet Shop, Buyer acknowledges and agrees to all terms contained herein. 

Buyer acknowledges that live animals are not manufactured goods. They are living organisms subject to biological variability, stress responses, environmental sensitivity, and natural behavioral instincts. 

Buyer understands and agrees:

• The condition of a live animal can change due to environmental stress, relocation, husbandry practices or exposure to other animals. 
• Once the animal leaves our physical custody, all responsibility for care, environment, feeding, and health transfers immediately to the Buyer. 
• No long-term health guarantee is provided or implied unless expressly stated in writing. 

All animals are visually inspected and confirmed to be in good observable health at the time of sale or shipment. 

Buyer acknowledges: 

• Minor cosmetic imperfections, healed scars, slight weight variations, incomplete sheds, and normal parasitic loads common to reptiles or fish may exist and do not constitute illness. 
• Stress-related behaviors (refusal to eat, hiding, color changes, defensive behavior) are normal following relocation. 
• The Company does not guarantee feeding response after transfer due to environmental differences. 

Unless explicitly provided in writing, no veterinary warranty is expressed or implied. 

Buyer understands that temperament is not guaranteed. 

Animals may exhibit: 

• Defensive behavior 
• Biting 
• Musk spraying 
• Tail whipping 
• Hiding 
• Food Aggression 
• Territorial behavior 

Temperament can change due to age, breeding season, relocation stress, enclosure changes, or hormonal development.

No animal is sold as "tame," "docile," or "child-safe" unless explicitly stated in writing – and even then, such statements describe observed behavior at time of sale only, not future guarantees. 

We identify species, morphs, and traits to the best of our knowledge based on breeder records, supplier information, and visual assessment. 

Buyer acknowledges: 

• Genetic traits may express differently over time. 
• Some morphs may develop coloration changes as they mature. 
• We do not guarantee future color intensity or pattern development unless specifically sold under a written genetic guarantee. 

Unless explicitly listed as a confirmed hatch date or birth date in writing, age is an estimate based on size, supplier information, or developmental stage. 

Growth rates vary depending on husbandry, genetics, and feeding schedules. 

The company does not guarantee future size, growth speed, or breeding readiness. 

Sex identification is made to the best of our ability at the time of sale. 

Buyer acknowledges and agrees: 

• Some species cannot be accurately sexed at juvenile stages.
• Certain reptiles, amphibians, and fish require maturity or specialized testing to confirm sex. 
• Visual sexing techniques are not infallible. 

Unless explicitly marked "Guaranteed Sex" in writing, sex is not warranted. 

The Company is not liable for misidentification of sex where species characteristics make early sex determination uncertain. 

Custom Creatures Pet Shop ONLY ships:

• Reptiles 
• Amphibians
• Fish 
• Invertebrates 

We DO NOT ship mammals under any circumstances.

All shipped orders are governed by our separate Shipping Policy, including Live Arrival Guarantee terms, reporting requirements, and documentation procedures. 

By placing a shipped order, Buyer agrees to all conditions outlined in that policy. 

Failure to follow reporting timelines or documentation requirement voids and Live Arrival Guarantee. 

All mammals must be viewed in person at our physical retail location prior to purchase. 

No exceptions. 

We do not: 

• Ship mammals 
• Finalize mammal sales sight-unseen
• Conduct remote-only mammal transactions 

Buyer must physically inspect the mammal before completing purchase. 

Buyer agrees to: 

• Research species-specific care requirements prior to purchase.
• Verify legality of ownership at state, county, and municipal levels. 
• Provide proper enclosure, heat, UVB lighting (if applicable), humidity control, filtration (for aquatic species), substrate, and nutrition. 
• Quarantine new animals before introducing them to existing collections. 
• Seek qualified veterinary care when needed. 

The Company is not responsible for illness, injury, or death resulting from:

• Improper husbandry 
• Temperature or humidity errors 
• Introduction to other animals 
• Stress-related non-feeding
• Parasite exposure post-sale
• Inadequate veterinary intervention

All live animal sales are final. 

We do not provide cash refunds on live animal purchases. 

Any approved remedy, if applicable, is limited to:

• Replacement animal (if available), or
• Store credit

Shipping charges are non-refundable.

Return of live animals is not accepted unless explicitly authorized in writing.

To the fullest extent permitted by law: 

Custom Creatures Pet Shop shall not be liable for:

• Veterinary expenses 
• Diagnostic testing 
• Breeding losses 
• Lost profits 
• Emotional distress
• Incidental or consequential damages 

Total liability, if any, shall not exceed the original purchase price of the animal.
